Terms of Service

Joseph Budwick provides on-location pet photography services in NY, NJ, CT & surrounding areas under the name Zoomies Photo Co. The specific details of each session — including location, date, time, number of images, and any other deliverables — are agreed upon between Joseph Budwick and the client prior to the session date and confirmed in a service agreement.

Initial consultations are offered to discuss your session needs and are provided at no charge. A consultation does not constitute a confirmed booking. Sessions are confirmed upon completion of a signed service agreement.

Payment is due upon completion of the session. No deposit or advance payment is required. Accepted payment methods will be confirmed at the time of booking. Invoices will be provided upon request.

There is no formal cancellation policy. If you need to cancel or reschedule your session for any reason, please contact us as soon as possible: Email: contact@zoomiesphotoco.com Phone: +1 (201) 618-3374 We will make reasonable efforts to accommodate rescheduling requests based on availability. Last-minute cancellations may impact scheduling availability but will not result in automatic fees.

Because payment is due only upon session completion, refund situations are rare. All fees paid are non-refundable once a session has been completed and payment has been received. If you have concerns about your session or final images, please contact us directly and we will make reasonable efforts to address them.

Edited images will be delivered within a timeframe agreed upon between Joseph Budwick and the client prior to the session date. Delivery timelines are confirmed in writing before the session. Delivery timelines may be affected by factors outside our control, in which case we will communicate updated timelines promptly.

Joseph Budwick conducts on-location outdoor photography sessions. In the event of inclement weather, unsafe conditions, or other circumstances that make a session impractical, rescheduling will be arranged at the mutual discretion of Joseph Budwick and the client. Weather-related rescheduling will not result in any fees to the client.

Clients are responsible for: • Ensuring their pet(s) are under control at all times during the session • Compliance with all applicable local laws, leash laws, and park regulations at the session location • Disclosing any known behavioral concerns about their pet prior to the session • Ensuring the safety of their pet, themselves, and others during the session Joseph Budwick reserves the right to terminate a session if a pet's behavior poses a safety risk to any person, animal, or property. In such cases, fees already paid are non-refundable.

Joseph Budwick retains full copyright ownership of all photographs taken during sessions. Upon payment in full, clients receive a non-exclusive personal use license to use their delivered images for personal, non-commercial purposes including printing, sharing, and displaying. Joseph Budwick retains the right to use photographs taken during sessions for portfolio display, website use, social media, and other promotional purposes. If you prefer that your pet's images not be used for promotional purposes, please notify us in writing before the session and we will honor that request.

Clients acknowledge that photography equipment is valuable and fragile. If a client's pet causes damage to Joseph Budwick's equipment or personal property during a session, the client agrees to be responsible for the reasonable cost of repair or replacement of damaged items.

Joseph Budwick is not responsible for circumstances beyond our reasonable control, including but not limited to equipment failure, weather events, location access issues, or unpredictable pet behavior. Our total liability for any claim arising from a photography session is limited to the total fees paid by the client for that session.

These Terms of Service are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising from or relating to these terms or any photography session shall be subject to the jurisdiction of the courts of the State of New Jersey.

We may update these Terms of Service from time to time. When we do, we will update the 'Last updated' date at the top of this page. Continued use of our website or booking of sessions after any changes constitutes acceptance of the updated terms.
